Democracy Day: N-Delta Group Urges Tinubu to Set Up 13% Derivation Fund Board, Presidential Monitoring Committee

Civil society stakeholders in the Niger Delta have called on President Bola Tinubu to establish a 13 per cent Derivation Fund Board and a Presidential Monitoring Committee to ensure transparency, accountability and direct development impact in oil-producing communities.


In a Democracy Day statement signed by its Coordinator, Comrade Ezekiel Kagbala, the Niger Delta Civil Society Forum (NDCSF) faulted the position of the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC) that the Petroleum Industry Act had adequately addressed the developmental needs of host communities.

The group described the claim as “legally flawed and misleading,” insisting that the 13 per cent derivation fund is a constitutional entitlement under Section 162(2) of the 1999 Constitution and cannot be replaced by the Host Community Development Fund established under the Petroleum Industry Act.

“The derivation principle is constitutional compensation for oil-producing communities. It is not mentioned anywhere in the PIA and cannot be substituted by it,” the Forum stated.

The NDCSF argued that the current disbursement structure has encouraged alleged misallocation of funds and denied host communities the benefits intended by the Constitution.

It therefore urged Tinubu to constitute a Presidential Board for the management of the fund in oil-producing states and a Presidential Monitoring Committee to oversee implementation, project execution and accountability.

According to the group, more than ₦620 billion was allocated to oil-producing states within five months in 2025, yet many host communities remain underdeveloped despite bearing the environmental and economic costs of oil exploration.

“Democracy is strengthened when constitutional provisions are implemented transparently and citizens can see tangible benefits in their communities,” the statement added.
