MAMI MARKET DEMOLITION: RIGHTS ACTIVIST EBIS MARTHA CALLS FOR URGENT GOVERNMENT INTERVENTION

A Call for Justice, Humanitarian Relief and Protection of Livelihoods, the demolition of Mami Market in Effurun Sapele Road Delta State, reportedly carried out without prior notice to affected occupants, has left numerous people homeless and traders without their means of livelihood.

Comrade Ebis Martha, Rights Activist with the Organization for Human and People’s Rights Protection and Humanitarian (OHPRPH), calls on the Delta State Government and relevant authorities to urgently intervene and provide temporary shelter, alternative trading spaces and humanitarian assistance to those affected.

Although the land is reportedly leasehold land, this does not automatically give any authority the right to evict occupants without complying with applicable laws, the terms of the lease and due process.

Section 34(1) of the Constitution of the Federal Republic of Nigeria 1999 (as amended) protects human dignity. Section 36(1) guarantees fair hearing in the determination of civil rights and obligations, while Section 44 provides safeguards concerning compulsory acquisition of property, subject to its applicable conditions and exceptions.

The applicability of these provisions depends on the circumstances, the nature of the interests affected and the legal authority for the demolition.

We therefore urge the Delta State Government to investigate the circumstances surrounding this demolition and take immediate steps to assist displaced families and restore opportunities for affected traders to earn a living.

Development must not come at the expense of human dignity. People who have lost their homes and livelihoods deserve urgent attention, humane treatment and access to justice.
